Generally, people today get married when they are in love, but it is important to remember that it is a binding contract, regardless of whether you took the time to define the boundaries and expectations in a pre-nuptial agreement. You and your spouse will receive inheritance rights (unless otherwise arranged), and have a say in medical decisions with the other person who is incapacitated. You will also be jointly responsible for your spouse’s debt and assets. You may also benefit from IRS tax fillings.

How to Get Common Law Married

Texas makes it really easy to get married. You can get married by a spiritual authority, a judge, and by common law marriage. In fact, if you want to make sure you don’t fall into a common law marriage unintentionally, you should sign a co-habitation agreement, and be mindful of avoiding words as “my wifey/hubby” in public, as you may open up the interpretation of being common law married and require a legal divorce upon break-up.

Common Law Marriage Qualifications

  1. Both parties must be a legal adult (18 years old).
  2. Both parties cannot be closely genetically related (no siblings, parents, 1st cousins, half-cousins, aunts/uncles).
  3. Both parties must be unmarried to anyone else.
  4. Both parties must agree, without duress, that they are married.
  5. Both parties must live together as a marital couple.
  6. Both parties must present themselves as married to the public.
